Five men are accused of breaking into an ATM in Sterling Heights and one of them faces an immigration hold after they were caught in the act last month by police, according to Macomb County prosecutors.

The men were seen April 15 by Sterling Heights officers breaking into the money machine at Blue Ox Credit Union on Van Dyke Avenue between 17 and 18 mile roads, police said. When officers activated their emergency lights and sirens, one was apprehended at the scene while four fled on foot and were captured by chasing officers, officials said.

The suspect who did not flee, Jose Leonardo Aguilar, 31, of Mount Clemens, had a hold placed on him by U.S. Immigration and Customs Enforcement in addition to a $250,000 bond, officials said. He remained in the county jail Friday charged with safe breaking and conspiracy to commit safe breaking.

Also charged are Eyder Bueno Francia, 24, of Mount Clemens; Dyfred Jofiel Reyes-Palacios, 28; Jaimes Randy Hermoso, 20, and Howard Dejesus Jaen Gil, 28, of Arkansas, all of whom also face charges of safe breaking and conspiracy. The charges are punishable by up to life in prison. Francia also is charged with possession of burglary tools. They each were given a $250,000 bond.

They face a May 14 probable-cause conference in front of Judge Kimberly Wiegand.

“The sharp-eyed and quick-footed efforts of our law enforcement officers were able to stop this criminal activity as it was happening,” county Prosecutor Peter Lucido said in a new release.
